3.14 Certification at End of Construction

Due date for completion

Unless otherwise specified in the agreement, the due date for completion of the construction of the works is 12 months after the date of the Acceptance of the Offer (Due Date).

Certification Statement

When all works have been completed so as to comply with the requirements of the Drawings and Specifications, the Owner must submit the following information to Melbourne Water by the due date:

  1. Construction Certification Statement
  2. Survey 'As Constructed' Certification Statement
  3. 'As Constructed' survey information.

These documents can be found in the Forms section.

The Certification Statement must:

  1. be in the form supplied by Melbourne Water
  2. include any supporting documentation specified
  3. be authorised by the Owner's nominated representative.

Melbourne Water will not accept the Construction Certification Statement if it has reason to believe that there are discrepancies between the condition of the works as certified and as constructed.

Certificate of Practical Completion

Following receipt of the Construction Certification Statement and supporting information, and provided that there are no discrepancies between the condition of the works as certified and as constructed, Melbourne Water will issue a Certificate of Practical Completion.

Letter of Release

Following satisfactory receipt of the information specified in 'Owner to submit certification statement' above and compliance by the Owner with all other conditions of the agreement, Melbourne Water will issue a Letter of Release to Council for the subdivision.

Defects Liability Period

The defects liability period commences from the date of the Certificate of Practical Completion.

Main drainage works are transferred to Melbourne Water following completion of the defects liability period. Only appropriately qualified people authorised by Melbourne Water are permitted to enter Melbourne Water drains. Prior to transfer, the asset remains the responsibility of the developer and the Contractor. See Working on Live Assets for more information.

The Owner is responsible for all reasonable costs incurred by Melbourne Water during the defects liability period. These costs will be included when the account is finalised. Melbourne Water reserves the right to extend the defect liability period. Such extended period will be specified in the special conditions of the agreement

The Owner must submit an End of Defects Liability Period Certification Statement at the end of the defects liability period. This document can be found in the Forms section.

The Certification Statement should be in the form supplied by Melbourne Water (see Forms section) and include any supporting documentation as may be appropriate.

The Owner's nominated representative must certify that all works still comply with the Construction Certification Statement and that the construction of the development's roads and other services is complete.

Melbourne Water will not accept the End of Defects Liability Period Certification Statement if it has reason to believe that there are discrepancies between the condition of the Works as certified and as existing.
